PRIVACY POLICY

This privacy policy is valid from May 25, 2018. The information contained in this document concerns the processing by Genus Sp. z o. o. with its registered office in Warsaw (02-672) at ul. Domaniewska 37 lok 2.43 (hereinafter referred to as Genus Sp. z o. o.) personal data of contractors in connection with concluded purchase contracts. The information provided is in accordance with Art. 13 section 1 and section 2 Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - the so-called GDPR). At any time when personal data is processed, Genus Sp. z o. o. respects and respects the privacy of contractors.

1. Data administrator and contact details

The administrator of your contractors' personal data is Genus Sp. z o. o. with its registered office in Warsaw (02-672) at ul. 2. Purpose of data collection

Your personal data will be processed for the purposes of: taking action before concluding a contract or performing a contract (e.g. accepting orders, considering complaints); fulfilling the legal obligations of the data controller (e.g. storing tax documentation); arising from legally justified interests pursued by Genus Sp. z o. o. (e.g. direct marketing of own products, including via a newsletter, securing and pursuing claims, securing and protecting against claims of contractors);

3. Legal basis for the processing of personal data

The legal basis for data processing is Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (general data protection regulation), in particular Art. 6 section 1 of this Regulation establishing general principles of lawfulness of data processing.

4. Recipients of personal data

During their processing, personal data may be disclosed to the following categories of recipients: the contractor and persons authorized by the contractor to whom the personal data relates; people employed at Genus Sp. z o. o. and authorized to process personal data; entities processing data on behalf of Genus Sp. z o. o. and authorized persons employed by these entities (e.g. delivery of products by transport companies, operation of IT infrastructure by hosting companies); in the event of the contractor's consent to transfer data to other entities for marketing purposes.

5. Transferring personal data to third countries (outside the European Union) or international organizations

Genus Sp. z o. o. does not transfer personal data to third countries (outside the European Union) or international organizations. If such an intention occurred, Genus Sp. z o. o. will make every effort to ensure that, if it is necessary to transfer data to a third country or an international organization, it is a country or organization for which the European Commission (in accordance with the General Data Protection Regulation) has determined an adequate level of protection. Otherwise, Genus Sp. z o. o. will be able to transfer personal data to a third country or international organization only provided that appropriate safeguards are provided and that enforceable rights of data subjects and effective legal remedies referred to in the General Data Protection Regulation are in force and taking into account the transfer to the contractor information about the possibilities of obtaining a copy of the data or about the place where the data is made available.

6. Data processing periods

Personal data is processed:

  • in the case of processing personal data for the purposes of executing an order or concluding an Agreement (legal basis: Article 6(1)(b) of the GDPR): from the moment of collecting data before concluding the contract for the purpose of concluding it or from the moment of collecting this data during the conclusion of the Agreement or from the moment of collecting this data during the term of the contract (in the event of supplementing or updating the data during the term of the contract) until the termination of the contract or implementation of the contract after its termination (e.g. consideration of complaints);
  • in the case of processing personal data in order to fulfill obligations arising from legal provisions (legal basis: Article 6(1)(c)) for the period of performance of obligations and tasks arising from individual legal provisions;
  • in the case of processing personal data for purposes arising from the legitimate interests of Genus Sp. z o. o. (legal basis: Article 6(1)(f)) the data will be stored until a justified objection is raised to processing for such a purpose;
  • in the case of collecting personal data on the basis of consent (legal basis: Article 6(1)(a) or (f) of the GDPR): from the moment of consent to the processing of data covered by it (also during the implementation of the contract) until the moment of implementation of the request to withdraw this consent , in the event of its withdrawal, or until an objection is noted;
  • apart from the situations mentioned above, data may be stored during the period of restriction of processing of these data established at the request of the contractor, request of the supervisory authority - in the situations provided for by the GDPR in Art. 18 and art. 58.

7. Rights of the data subject related to the processing of personal data

You have the right to access your data and the right to rectify, delete, limit processing, the right to transfer data, the right to object, the right to withdraw consent at any time without affecting the lawfulness of processing (if the processing takes place on the basis of based on consent), which was made on the basis of consent before its withdrawal. You have the right to lodge a complaint with the supervisory authority under the principles set out in the General Data Protection Regulation, in particular pursuant to Art. 77 of this regulation. In Poland, the supervisory authority since May 25, 2018 is the Personal Data Protection Office.

8. Data categories. Requirement to provide data. Consequences of failure to provide data.

Genus Sp. z o. o. informs that providing the following data is a contractual requirement and a condition for concluding the contract: name, surname, billing and delivery address, e-mail address, contact telephone number. Providing all data is voluntary, but necessary to conclude the contract. The consequence of not providing data that is a condition for concluding a contract is the inability to conclude with Genus Sp. z o. o. contracts.

9. Processing of personal data in an automated manner (e.g. profiling)

When using the Administrator's websites, user data such as: IP address, redirecting domain name, browser type, operating system type are automatically collected. These data are used by the administrator only for statistical purposes.

Taking into account the provisions of Art. 4 point 4 and art. 22 section 1 of the General Data Protection Regulation), we declare that cookie identifiers (so-called cookies) generated on contractors' end devices, which are processed in an automated manner, are not used for profiling, and the scope and method of processing make it impossible to identify the natural person whose data concern.

Cookies - the so-called cookies

In accordance with the amendment to the Telecommunications Law, from March 22, 2013, the owners of all websites that use the so-called "cookies", are required to obtain consent from the website viewer to install them.

Cookies - small text information (files) sent by the web server and saved on the user's side (on the end device). The default cookie parameters allow only the server that created them to read the information contained therein. These files allow you to recognize the user's device and properly display a website tailored to his or her individual preferences. "Cookies" usually contain the name of the website they come from, their storage time on the end device and a unique number used to identify the browser from which the website is connected. Cookies are most often used for counters, polls, online stores, websites requiring login, advertisements and to monitor visitor activity.

Cookies are used to adapt the content of websites to user preferences and optimize the use of websites. They are also used to create anonymous, aggregated statistics that help understand how the user uses websites, which allows improving their structure and content, excluding personal identification of the user.

Two types of cookies are used - "session" and "persistent". The first of them are temporary files that remain on the user's device until logging out of the website or turning off the software (web browser). "Permanent" files remain on the user's device for the time specified in the "cookie" file parameters or until they are manually deleted by the user.

On our websites, an example of the use of cookies is Google Analytics statistics. Each user visiting our website downloads "cookies" that are needed by Google to analyze user traffic on the website.

Cookies are small pieces of text and do not pose any risk to the user. They are not computer programs and cannot be used to spread viruses. Each user can manage cookies independently. The level of cookie protection is set in each browser, up to complete blocking of Cookies. This increases the level of security and data protection, but may also prevent the use of various functions on the websites. Detailed information about the possibilities and methods of handling cookies is available in the software (web browser) settings.

How to disable cookies in your browser?

From the moment of obtaining information about "cookies", every decision of the user of our websites will be an expression of a conscious act of will. By remaining on our website, the user consents to receiving cookies from the website and using our website.

10. Final information

The principles described in the document apply from May 25, 2018 - i.e. from the date of application of the GDPR. Genus Sp. z o. o. reserves the right to constantly improve and improve the form and content of this privacy policy. Contractors will be informed about changes in the content of the privacy policy via an appropriate message on the Administrator's websites. The User is obliged to comply with this privacy policy.
